For manufacturers placing radio equipment on the European Union market, these capabilities bring specific regulatory responsibilities under Directive 2014/53/EU — the Radio Equipment Directive, commonly known as the RED.

RED compliance goes considerably beyond checking whether a radio transmitter operates at the intended frequency. Depending on the equipment, the conformity assessment may need to address health and safety, electromagnetic compatibility, effective and efficient use of radio spectrum and certain additional requirements applicable to particular categories or classes of radio equipment.

For connected radio products, cybersecurity, privacy and fraud-protection requirements have also become an increasingly important part of the European compliance landscape.

THE REGULATORY FOUNDATION

Understanding the Radio Equipment Directive

Directive 2014/53/EU establishes the European regulatory framework governing the placing of radio equipment on the Union market.

At its core, the RED is intended to ensure that radio equipment meets essential requirements concerning health and safety, electromagnetic compatibility and the effective and efficient use of radio spectrum.

Adding a radio module can change the regulatory route of an otherwise conventional product. A manufacturer incorporating Wi-Fi, Bluetooth, cellular or another radio technology should therefore reassess the complete product rather than assuming that the module’s existing approvals automatically establish conformity of the final equipment.

ARTICLE 3

The RED Essential Requirements

Article 3 establishes the central essential requirements against which radio equipment is assessed.

Health & Safety

Radio equipment must protect the health and safety of persons and domestic animals and protect property, including the safety objectives associated with the Low Voltage Directive but without application of the LVD voltage limits.

Electromagnetic Compatibility

Radio equipment must provide an adequate level of electromagnetic compatibility as required through the relevant EMC essential requirements.

Radio Spectrum

Radio equipment must be constructed so that it both effectively uses and supports the efficient use of radio spectrum in order to avoid harmful interference.

Additional Requirements

Particular categories or classes of radio equipment may be subject to additional essential requirements activated through EU legislation.

The RED creates a combined compliance framework. Manufacturers should evaluate the complete radio product across all applicable essential requirements rather than treating RF, EMC and safety as unrelated certification projects.

ARTICLE 3(2)

Effective & Efficient Use of Radio Spectrum

One of RED’s defining requirements is that radio equipment must be constructed so that it both effectively uses and supports the efficient use of radio spectrum in order to avoid harmful interference.

Operating Frequency

The equipment’s intended frequency bands and radio configuration must be identified and assessed.

Transmitter Power

RF output characteristics should comply with applicable technical requirements and spectrum conditions.

Unwanted Emissions

Spurious and out-of-band emissions should be controlled to reduce the potential for harmful interference.

Receiver Performance

Applicable radio standards may include receiver characteristics important to effective spectrum use.

Antenna Configuration

Antenna type, gain, placement and permitted configurations can affect RF performance and established compliance.

Spectrum Access

Depending on the technology, mechanisms controlling access to the radio spectrum may form part of the technical assessment.

A radio that successfully communicates is not necessarily a compliant radio. RED conformity concerns how the equipment uses spectrum and whether its operation can coexist appropriately with other spectrum users.

SAFETY + EMC

How RED Interacts With LVD & EMC Requirements

Radio equipment requires more than RF spectrum compliance. Article 3(1) incorporates important health, safety and electromagnetic compatibility requirements into the RED framework.

Safety

RED incorporates the safety objectives associated with Directive 2014/35/EU, but without applying the LVD’s voltage limits.

EMC

RED also requires an adequate level of electromagnetic compatibility through the essential requirements associated with Directive 2014/30/EU.

Consequently, low-voltage battery-powered radio equipment can still be subject to electrical and product-safety requirements even though its operating voltage would be below the normal LVD voltage range.

This is a critical distinction. Do not conclude that a low-voltage wireless product has no safety obligations simply because the standalone Low Voltage Directive would not apply at that voltage. RED Article 3(1)(a) applies the relevant safety objectives without a voltage limit.

CONNECTED PRODUCT SECURITY

RED Cybersecurity, Privacy & Fraud-Protection Requirements

The regulatory scope of RED has expanded significantly for certain categories of connected radio equipment.

Commission Delegated Regulation (EU) 2022/30 activated selected Article 3(3) essential requirements for specified categories and classes of radio equipment. Following the amended application date, these requirements apply from 1 August 2025.

Article 3(3)(d) · Network Protection

Applicable radio equipment must incorporate safeguards intended to ensure that it does not harm networks or their functioning or misuse network resources in a way that causes unacceptable degradation of service.

Article 3(3)(e) · Privacy & Personal Data

Applicable equipment must incorporate safeguards to ensure that the personal data and privacy of users and subscribers are protected.

Article 3(3)(f) · Fraud Protection

Applicable radio equipment must support features intended to provide protection from fraud where the regulatory conditions apply.

Product Applicability

These requirements do not apply identically to every radio product. Manufacturers must determine which activated requirements apply to the specific category and functionality of their equipment.

Cybersecurity is now a CE conformity issue for affected radio equipment. For applicable products, security should therefore be considered during product architecture and development — not added as a documentation exercise immediately before market launch.

PRESUMPTION OF CONFORMITY

Harmonised Standards Under RED

Harmonised European standards provide one of the principal technical routes for demonstrating conformity with RED essential requirements.

Where radio equipment conforms to applicable harmonised standards, or relevant parts of them, whose references have been published in the Official Journal of the European Union, the equipment benefits from presumption of conformity for the requirements covered by those standards.

Radio Spectrum Standards

Technology-specific EN standards can address transmitter, receiver and spectrum-utilisation characteristics.

EMC Standards

Appropriate standards address emissions, immunity and the electromagnetic behaviour of radio equipment.

Safety Standards

Product-specific safety standards can support demonstration of the applicable health and safety requirements.

Human Exposure

Applicable standards may address exposure to electromagnetic fields for equipment used close to or around persons.

Cybersecurity Standards

Applicable harmonised standards can support assessment against activated RED cybersecurity, privacy and fraud-protection requirements.

Product-Specific Standards

The correct standards depend on radio technology, frequency band, operating mode, product category and intended environment.

Always verify OJEU status. The existence of an EN standard does not by itself establish presumption of conformity. Manufacturers should verify the applicable edition, restrictions and current Official Journal citation status for each essential requirement being claimed.

TECHNICAL VERIFICATION

Radio Equipment Testing

RED testing should be defined around the actual radio technology, frequency bands, product configuration, antenna system, interfaces, intended environment and applicable essential requirements.

Electrical / Product Safety Assessment of applicable health and safety requirements.
RF Exposure Evaluation of human exposure to electromagnetic fields where applicable.
Cybersecurity Assessment of applicable security, privacy and fraud-protection requirements for affected equipment.
Test the marketed configuration. Firmware, antennas, RF power settings, enclosure construction, cables and supported radio modes can all influence compliance. Changes after testing should therefore be assessed before assuming that previous evidence remains valid.

CONFORMITY ASSESSMENT

Choosing the Correct RED Conformity Assessment Route

RED provides several conformity assessment procedures. The route available to the manufacturer depends in part on the essential requirements being assessed and whether applicable harmonised standards have been applied.

Module A

Internal Production Control may be used under the conditions established by the Directive, including where applicable harmonised standards covering the relevant requirements have been applied.

Modules B + C

EU-Type Examination by a Notified Body followed by conformity to type based on internal production control.

Module H

Conformity based on Full Quality Assurance, involving assessment and surveillance of the manufacturer’s approved quality system by a Notified Body.

Notified Body involvement is conditional — not automatically required for every RED product. The applicable route should be established after reviewing the essential requirements, harmonised standards used and the specific conformity assessment provisions of the Directive.

TECHNICAL FILE

Building the RED Technical Documentation

RED technical documentation should provide sufficient evidence to assess the radio equipment’s conformity with the applicable essential requirements.

General product description. Identify the equipment, model, variants, intended use and radio functions.

Design information. Include relevant drawings, schematics, PCB information and technical architecture.

Radio configuration. Document frequency bands, maximum RF power, modulation, antennas and operating modes.

Risk assessment. Address applicable health, safety, EMC, spectrum and additional RED requirements.

Standards matrix. Identify harmonised standards and other technical specifications applied.

Test reports. Maintain applicable RF, EMC, safety, exposure and other supporting evidence.

Retention period: the manufacturer must retain the technical documentation and EU Declaration of Conformity for 10 years after the radio equipment has been placed on the market.

FORMAL MARKET ACCESS

EU Declaration of Conformity & CE Marking

Once conformity has been established through the appropriate assessment procedure, the manufacturer prepares the EU Declaration of Conformity and affixes the CE marking.

Product Identification

The equipment should carry appropriate type, batch, serial or other identification allowing traceability.

Manufacturer Information

Required manufacturer name and postal contact information must be provided.

EU Declaration

The manufacturer declares under its responsibility that the equipment complies with the applicable Union legislation.

CE Marking

The CE marking must be applied in accordance with the Directive and applicable general CE marking rules.

Radio equipment must also be accompanied by appropriate instructions and safety information. Information concerning frequency bands and maximum radio-frequency power transmitted in those bands must be provided as required by the Directive.

CE marking is the regulatory conclusion, not the test itself. The underlying conformity assessment, technical documentation, standards evidence and production controls must support the declaration represented by the CE mark.

COMPLIANCE RISK

Common RED Compliance Failures

Common Issue Why It Creates Risk

Firmware changed after testing Software can alter RF power, frequency behaviour and other regulated characteristics.
Cybersecurity applicability overlooked Applicable Article 3(3) requirements may remain unevaluated.
Incomplete EU Declaration of Conformity Legislation, standards or product identity may not correspond with the marketed equipment.
A pre-approved radio module can reduce engineering effort, but it does not automatically CE mark the final product. The manufacturer placing the finished radio equipment on the EU market remains responsible for establishing conformity of that final equipment.

COMMON CHARGER

USB-C & Common Charger Requirements

The RED framework has also been amended to introduce common charging requirements for specified categories of rechargeable portable radio equipment.

For covered categories, the rules introduce USB Type-C charging requirements and associated charging-technology provisions intended to improve interoperability and reduce unnecessary charger waste.

Covered Product Categories

The requirements apply to specified categories of portable radio equipment rather than to every product within the RED scope.

USB Type-C

Covered equipment must comply with the applicable common charging receptacle and charging-technology requirements.

Charging Information

Manufacturers must provide the applicable information concerning charging characteristics in accordance with the amended RED framework.

Charger Bundling

The framework includes requirements enabling consumers to purchase covered radio equipment without a charging device where applicable.

Application dates depend on the equipment category. The common-charger requirements apply to the principal covered handheld categories from 28 December 2024, while the application date for laptops is 28 April 2026.
