Understanding CE Marking
CE marking indicates that a product has been assessed against the applicable requirements of EU legislation providing for CE marking. By affixing the mark, the manufacturer declares responsibility for the product’s conformity with those applicable requirements.
It is therefore important to distinguish CE marking from a conventional product certification scheme. There is no single central European authority that reviews every CE-marked product and grants a universal “CE certificate”.
CE Marking Is
A regulatory conformity marking demonstrating that the manufacturer has followed the applicable EU conformity assessment requirements.
CE Marking Is Not
A general quality award, commercial approval mark, country-of-origin indication or universal certificate issued by the European Commission.
Identify the Applicable EU Legislation
The starting point is product classification. Manufacturers need to understand the product’s intended use, technical characteristics, operating environment and potential hazards before determining which European legislation applies.
One product may fall within the scope of several EU legal acts simultaneously. An electrically powered connected machine, for example, can potentially involve machinery safety, electromagnetic compatibility, radio equipment and hazardous substance requirements depending on its design and functions.

Define intended use, design, users, operating conditions and product configuration.
Legislation
Map every potentially applicable EU directive and regulation against the product.
Scope
Confirm inclusion, exclusions, definitions, thresholds and transitional provisions.
This applicability assessment should be performed before testing begins. Testing a product against an incomplete set of standards cannot compensate for an incorrect regulatory classification.

Once the applicable legislation has been established, the next task is to determine the product-specific requirements that must be satisfied.
Depending on the legislation, these can address electrical safety, mechanical hazards, pressure integrity, electromagnetic compatibility, radio spectrum use, explosion protection, materials, chemical substances, functional safety, instructions, warnings, traceability and other characteristics.
Harmonised Standards & Technical Specifications
European harmonised standards provide manufacturers with practical technical routes for addressing requirements established by EU harmonisation legislation.
Where the conditions of the applicable legislation are met and the relevant standard has been cited appropriately in the Official Journal of the European Union, application of the relevant harmonised standard can provide a presumption of conformity with the legal requirements covered by that standard.
Standard selection therefore requires more than finding an EN number. Edition status, amendments, product scope, applicable clauses and the relationship between the standard and the legislation all need to be reviewed.

CE marking legislation does not impose one universal conformity assessment procedure. The required route depends on the applicable legal act, product type, risk category and, in some regimes, the standards or conformity assessment modules selected.
Manufacturer Assessment
Some legislation permits conformity assessment to be performed under the manufacturer’s own responsibility without mandatory intervention by a Notified Body.
Third-Party Assessment
Other product categories require designated independent conformity assessment activities through a Notified Body.
This distinction must be established early. Obtaining a commercial or voluntary “CE certificate” does not replace a legally required conformity assessment procedure, nor does unnecessary third-party certification transfer the manufacturer’s regulatory responsibility to another organisation.

Documentation should tell a coherent compliance story: what the product is, which requirements apply, how risks were controlled, what standards were used and what objective evidence demonstrates conformity.

The EU Declaration of Conformity is the manufacturer’s formal declaration that the product satisfies the applicable EU legislation identified in the declaration.
Depending on the applicable legal framework, information commonly includes product identification, manufacturer information, applicable legislation, referenced standards or technical specifications, relevant Notified Body information where applicable, and the authorised signatory.
Affix the CE Mark Correctly
CE marking should only be affixed once the applicable conformity assessment process has been completed and the necessary supporting documentation has been established.
The mark must follow the prescribed graphical proportions and applicable rules on visibility, legibility and permanence. Where product-specific legislation permits alternatives because of the nature of the product, marking may also involve packaging or accompanying documentation.
