Designing and manufacturing a recreational boat for the European market involves considerably more than demonstrating that the craft can float, manoeuvre and perform as intended. The manufacturer must also demonstrate that the watercraft satisfies a comprehensive set of safety, environmental, construction and identification requirements.

Directive 2013/53/EU establishes the European conformity framework for recreational craft, personal watercraft, certain components and propulsion engines.

The Directive addresses essential requirements relating to design and construction, stability and buoyancy, structural integrity, handling, onboard systems, fire protection, identification, exhaust emissions and noise emissions.

It also establishes watercraft Design Categories A, B, C and D, conformity assessment procedures and a specific Post-Construction Assessment route for defined situations where conformity was not established by the original manufacturer.

Understanding the Recreational Craft Directive

Directive 2013/53/EU establishes requirements for the design and manufacture of recreational craft, personal watercraft and other specified marine products placed on the European market.

Products within scope may be made available on the market or put into service only when they satisfy the applicable essential requirements and do not endanger persons, property or the environment when correctly maintained and used for their intended purpose.

PRODUCT SCOPE

Which Products Fall Within the Directive?

Directive 2013/53/EU covers several different marine product categories. Correct classification is important because the applicable essential requirements and conformity routes differ according to the product.

Recreational Craft

Watercraft intended for sports and leisure purposes within the Directive’s relevant hull-length scope.

Personal Watercraft

Watercraft intended for sports and leisure use where the operator sits, stands or kneels on rather than inside the craft.

Partly Completed Craft

Recreational craft or personal watercraft supplied before all construction necessary for complete conformity has been finished.

Propulsion Engines

Engines installed or specifically intended for installation on or in applicable watercraft.

Specified Components

Certain components listed by the Directive when placed separately on the Union market.

Modified Watercraft or Engines

Products subject to major craft conversion or major engine modification can trigger additional conformity responsibilities.

Not every boat is within the Directive. Specific exclusions exist for defined products such as certain racing craft, human-powered craft, historical craft, experimental craft and other categories. Scope should therefore be confirmed before a conformity programme is established.

OPERATING ENVIRONMENT

Watercraft Design Categories A, B, C & D

Recreational craft are assigned a design category according to the wind force and significant wave height conditions for which they are designed.

Category A Exceeding Beaufort 8 Exceeding 4 m Designed for severe wind and sea conditions, excluding abnormal conditions specifically identified by the Directive.
Category B Up to and including Beaufort 8 Up to and including 4 m Designed for significant offshore-type wind and wave conditions.
Category C Up to and including Beaufort 6 Up to and including 2 m Designed for moderate wind and wave conditions.
Category D Up to and including Beaufort 4 Up to and including 0.3 m Designed for relatively sheltered operating conditions, with occasional waves up to the limit addressed by the Directive.
The design category is an engineering requirement, not simply a marketing description. The craft must possess stability, buoyancy, structural performance and handling characteristics appropriate to the environmental parameters associated with its declared design category.

ANNEX I

Essential Design & Construction Requirements

Annex I establishes essential requirements covering a broad range of design and construction characteristics.

Structural Integrity

Hull construction and structural arrangements should be suitable for the intended design category and operating loads.

Stability

Craft should possess adequate stability for the declared loading and operating conditions.

Buoyancy

Appropriate buoyancy and flotation characteristics should be demonstrated where required.

Handling

Watercraft should demonstrate suitable handling characteristics for their intended operating environment.

Protection from Falling Overboard

Design should address protection from falling overboard and means of reboarding where applicable.

Visibility

The helm position should provide appropriate all-round visibility under intended operating conditions.

Flooding

Hull openings, through-hull fittings and other features should be designed to reduce the risk of flooding.

Manufacturer’s Maximum Load

The craft should be assessed for the maximum recommended loading declared by the manufacturer.

Means of Escape

Craft with enclosed accommodation should provide appropriate means of escape where required.

The Directive assesses the complete craft as a system. Hull design, loading, stability, machinery, electrical systems, fuel systems, steering and other onboard systems interact and should therefore be evaluated as part of the complete watercraft.

NAVAL & STRUCTURAL SAFETY

Stability, Buoyancy & Structural Integrity

Stability and buoyancy are central elements of recreational craft conformity because they influence the craft’s ability to operate safely under its declared loading and environmental conditions.

Stability Assessment

Stability characteristics should be evaluated against the appropriate design assumptions and loading conditions.

Buoyancy Assessment

Applicable craft should demonstrate adequate buoyancy and flotation performance.

Maximum Recommended Load

Persons, equipment and other permitted loads influence both stability and structural performance.

Structural Loads

Hull, deck and structural components should withstand the loads reasonably associated with the declared design category.

Stability documentation should correspond to the actual marketed configuration. Significant changes to machinery, tank arrangements, batteries, superstructure, equipment or loading assumptions can affect established stability and should be evaluated before previous evidence is reused.

Fuel, Electrical, Steering & Fire Protection Systems

Many recreational craft risks arise not from the hull itself but from the systems installed within the completed boat.

Fuel Systems

Fuel tanks, lines, ventilation and installation arrangements should minimise leakage, fire and explosion hazards.

Electrical Systems

Electrical installations should minimise risks associated with shock, fire and other electrical hazards.

Steering

Steering systems should provide appropriate control and reliability for the intended craft configuration.

Fire Protection

Craft should incorporate appropriate fire-prevention and fire-response measures where required.

Gas Systems

Permanently installed gas systems should be arranged to minimise leakage, accumulation and ignition risks.

Engine Spaces

Machinery spaces require appropriate installation, ventilation and protection considerations.

CE-marked onboard equipment does not automatically establish conformity of the completed craft. Installation, interfaces, ventilation, cable routing, fuel connections and overall system integration remain the responsibility of the watercraft manufacturer.

ENVIRONMENTAL PERFORMANCE

Propulsion Engines & Exhaust Emissions

The Directive contains exhaust-emission requirements applicable to propulsion engines within scope.

Engine Identification

Propulsion engines require appropriate identification and traceability information.

Exhaust Emissions

Applicable engines must satisfy the pollutant-emission limits established by the Directive.

Durability

Emission-control performance should remain appropriate over the applicable durability conditions.

Engine Modification

Major modifications can trigger new conformity responsibilities before the modified engine or craft is placed on the market or put into service.

Engine compliance and craft compliance are connected but not identical. A compliant propulsion engine does not remove the boat builder’s responsibility for installation, system integration and the other essential requirements applicable to the complete craft.

Noise Emission Requirements

Noise emissions form a separate environmental component of the Recreational Craft Directive.

Depending on the watercraft and propulsion arrangement, manufacturers may need to demonstrate that sound emissions comply with the applicable requirements before CE marking.

CONFORMITY ASSESSMENT

Selecting the Correct RCD Conformity Assessment Route

The available conformity assessment procedure depends on factors such as product type, watercraft design category, hull length, standards applied and the requirement being assessed.

Module A

Internal Production Control is available for defined product configurations where permitted by the Directive.

Module A1

Internal Production Control combined with supervised product testing.

Module B

EU-Type Examination by a Notified Body followed by an appropriate production conformity module.

Modules C / D / E / F

Different production conformity routes that can follow EU-Type Examination where applicable.

Module G

Conformity based on unit verification, suitable for certain individual craft or products.

Module H

Conformity based on full quality assurance with appropriate Notified Body involvement.

SPECIAL CONFORMITY ROUTE

Post-Construction Assessment

Directive 2013/53/EU includes a specific Post-Construction Assessment procedure for defined circumstances where the original manufacturer has not established the required conformity.

Private Import

A private importer can require post-construction assessment where the manufacturer has not carried out the necessary conformity assessment.

Major Craft Conversion

Significant conversion capable of affecting conformity can trigger reassessment before the craft is placed on the market or put into service.

Change of Intended Purpose

A craft previously outside the Directive can become subject to its requirements where its intended purpose is changed.

Own-Build Craft Sold Early

A craft built for own use and placed on the market before the applicable five-year period has elapsed requires the defined post-construction route.

Post-Construction Assessment is not a shortcut around normal manufacturer conformity. It is a specific regulatory procedure intended for the situations identified by the Directive and involves an appropriate Notified Body.

Recreational Craft Technical Documentation

Technical documentation should provide sufficient information to assess the product’s conformity with the applicable requirements.

Builder’s Plate, Identification & CE Marking

Recreational craft conformity is communicated through both formal documentation and physical identification applied to the craft.

Watercraft Identification Number

Each applicable watercraft requires the identification information prescribed by the Directive.

Builder’s Plate

The craft carries a permanently affixed builder’s plate containing required manufacturer and craft information.

Design Category

The declared Design Category forms part of the information provided on the builder’s plate.

Maximum Recommended Load

The manufacturer identifies the applicable maximum recommended load.

Recommended Persons

The number of persons for which the craft was designed is identified as required.

CE Marking

CE marking is applied after the applicable conformity assessment has been completed.

The builder’s plate is part of the conformity system. Information shown on the craft should correspond with the technical documentation, declaration, stability assessment, maximum load and Design Category established by the manufacturer.

Watercraft CE marking is not simply a label applied when construction is finished. The mark should be supported by a coherent chain of design, calculation, testing, inspection, documentation and conformity assessment evidence.

Recreational craft conformity is most efficient when CE requirements are incorporated into the boat-development programme from the beginning.
